The aim of this study is to examine the decision-making processes at work among French buyers—whether beginners or more experienced individuals, when confronted with a dilemma involving an ethical or non-ethical choice to be made. We go on to illustrate these dilemmas through the use of five original scenarios that reproduce typical situations that arise in a purchasing context in relation to the environment, physical integrity, conflict of interest, or paternalism. Based on 172 participants, the results of our study show (...) that, ethical decision-making depends very clearly on two main factors: expertise and gender. The study also reveals that there is not always a coherent link between ethical choices made and the reasons and justifications given for those choices. Ethical options chosen are not exclusively justified on the grounds of purely ethical reasons but also on the grounds of commercial or economic reasons, or else reasons of avoidance. (shrink)

De 1806 à 1822 une discussion est entamée par trois ecclésiastiques hispaniques éclairés, Funes, Mier et Llorente, autour de l’Apologie de Las Casas, lue par l’abbé Grégoire en 1800, qui dégageait le vigoureux défenseur des Indiens de toute responsabilité dans la traite des Noirs. Si la publication en 1875 de l’Historia de las Indias a donné a posteriori raison sur le fond à Grégoire, son raisonnement ne doit pas, à la lecture des propos des débatteurs, être complètement pris pour (...) argent comptant. C’est de manière abusive et contradictoire que Grégoire taxe l’historien Herrera de malveillance et de légèreté. De plus, les silences publics de Las Casas, comme son Historia Apologetica longtemps inédite, accréditent aussi certaines objections de Funes et de Llorente. Between 1806 and 1822 three enlightened Hispanic clergymen, Funes, Mier, and Llorente, opened a debate about the Apology of Las Casas read by Father Grégoire in 1800, a text which denied to the energetic advocate of the Indians any responsibility in black slave trade. Although the publication of the Historia de las Indias in 1875 proved Grégoire essentially right, close reading of the discussions of the three debaters shows that his argument should not be taken at face value. In an improper and contradictory way Grégoire accuses the historian Herrera of ill will and thoughtlessness. Moreover, Las Casas’ public silence, like his Historia Apologetica which remained unpublished for a long time, also substantiated some objections from Funes and Llorente. (shrink)

Mounier, refusant tout projet de philosophie chrétienne, parvient à articuler une matrice philosophique issue des pensées de Pascal, Descartes et Bergson à l'apport théologique de l'abbé Guerry.

Parmi les projets de Rousseau figurait un ouvrage intitule Principes du droit de la guerre. On a longtemps cru cet ouvrage perdu ou reste a l'etat d'ebauches fragmentaires. Or un travail sur des manuscrits (jusqu'alors publies separement et dans le desordre) a permis de reconstituer un texte tres abouti, qui est manifestement la premiere partie de cet ouvrage. La redecouverte de ce texte et son rapprochement avec les ecrits sur le Projet de paix perpetuelle de l'abbe de Saint-Pierre, sur lesquels (...) Rousseau a travaille immediatement apres, eclairent d'un jour nouveau sa conception des rapports entre les Etats. Les commentaires proposes degagent l'originalite et l'actualite des questions posees par Rousseau sur la nature et la genese de la guerre et sur le statut d'un droit inter-etatique. L'Etat est-il ce qui empeche les hommes de se faire la guerre ou est-il la cause de l'apparition de la guerre? La guerre peut-elle etre soumise a des regles de droit? Peut-on esperer une fin de toute guerre? A quelles conditions une forme d'institution confederale pourrait-elle assurer, par le droit, une paix perpetuelle? (shrink)

Jean-Jacques Rousseaus Schriften zur Stiftung eines fortdauernden Friedens unter den europäischen Völkern, Extrait du Projet de Paix Perpétuelle de Monsieur L'Abbé de Saint-Pierre und Jugement sur la Paix Perpétuelle, haben eigenständige Bedeutung in der systematischen Entfaltung einer Forderung der Rechtsphilosophie, die Kant später "nicht bloß [als] einen Teil, sondern den ganzen Endzweck der Rechtslehre innerhalb der Grenzen der bloßen Vernunft" hervorgehoben hat. Beide Schriften verdienen besondere Aufmerksamkeit, da ihnen eine gegenüber dem Abbé selbständige und weiterführende rechtsphilosophische Bedeutung (...) in der Entfaltung einer universalen Friedensidee zukommt, besonders auch im Hinblick auf die Genese von Kants berühmten Traktat Zum ewigen Frieden von 1795; so schreibt de Bastide in seinem Vorwort zur Erstausgabe des Extrait, man solle sich von dem Titel nicht täuschen lassen: "Der Analytiker [Rousseau] ist hier in sehr vielen Hinsichten der Schöpfer". In deutscher Sprache bislang nicht selbständig verfügbar, werden sie hier in einer das Original und die deutsche Übersetzung enthaltenden Neuausgabe mit einer ausführlichen Einleitung vorgelegt. Der 1756 verfaßte Extrait wurde erstmals veröffentlicht in der Ausgabe von de Bastide (Amsterdam 1761) und dann in die von Rousseau geplante, von ihm noch mit vorbereitete erste Gesamtausgabe seiner Werke von du Peyrou / Moultou (postum Genf 1782, dort Band 24) aufgenommen. Die ebenfalls 1756 abgeschlossene, aber zunächst zurückgehaltene Schrift Jugement wurde gemäß dem Willen Rousseaus in der genannten Ausgabe von 1782 (Band 24) überhaupt erstmals publiziert. Auf dieser mithin maßgebenden Textgrundlage beruht die vorliegende zweisprachige Neuausgabe. (shrink)

Também será considerada a questão, se os filmes têm um significado filosófico. O resultado é uma perspectiva (...) desconhecida, do princípio do século XVIII, em algumas temáticas contemporâneas. Du Bos argues that normally works of cinematic fiction are designed to give rise to ‘artificial passions’ that have the function of providing relief from boredom without the negative consequences that many alternative pursuits would have. Du Bos’ solution to the paradox of negative affect and his position on Aristotle’s doctrine of catharsis are also set forth in the interview. The question of whether films have philosophical significance is also taken up. The upshot is a somewhat unfamiliar early 18th-century perspective on some contemporary issues. The Abbé Sieyès is usually portrayed as a thoroughly modern thinker and a critic of the nostalgic Classical Republicanism of some of his contemporaries, in favour of a “modern republicanism”, founded upon the division of labour and commercial sociability in a nation composed of equal labourers and producers. But Sieyès’s unpublished manuscripts suggest he, in fact, regarded modern labourers as unskilled “Machines du Travail”, dulled by work and incapable of exercising the duties of citizenship, a critique grounded in a (...) critical account of commercial society as compared to the ideal republican polity. Where most scholars regard this as either a simple contradiction or a passing juvenile nostalgia, this paper argues that, influenced by Jean-Jacques Rousseau, Sieyès consistently sought to counteract the degrading effects of the inequalities generated by commercial society and the division of labour. It was on this basis that Sieyès sought to construct a new political system which would reconcile participatory politics with representative government, enabling all citizens to enjoy a life of Active Citizenship. Based on these insights, this paper reinterprets Sieyès’s political project as an attempt to reconcile the classical conception of citizenship with the demands of a commercial society. (shrink)

In 1790 the Count d'Antraigues, an eccentric eighteenth-century anti- revolutionary spy, claimed that he had been given a sequel to Jean-Jacques Rousseau's Social Contract explaining how states could prevent wars by forming international associations but that he had destroyed the manuscript because it might pose a threat to the French monarchy. Recent Rousseau scholars have generally assumed that d'Antraigues was lying. I suggest that the manuscript in question was a copy of the summary that Rousseau wrote in 1760 of (...) the Project for Perpetual Peace published earlier in the century by the Abbé de Saint-Pierre. I then explore the significance of d'Antraigues' view that Rousseau's comments on the Project constituted an extension of the Social Contract and that they had revolutionary implications. The article ends with references to the ways that Rousseau's summary and critique of Saint-Pierre have recently opened up new thinking about democratic, non-hierarchical models of international organization. When we read Rousseau's Social Contract, we tend to focus on its explicit goal, which is to investigate and establish a safe and legitimate rule of administration for a single political community. In accordance with the abstract character of the work, we tend to see this community as something pre-existing and isolated, without asking what those individuals who decide to submit to the rule of his general will had initially in common, and how the political body thus formed is related (...) to those who are not they themselves, but "the others", i.e., with other societies among which they will inevitably have to live. Such issues were of great importance to Rousseau, and only the fragmentary and inconclusive nature of the Social Contract explains why they did not receive the detailed treatment that would be due to them. In this paper I intend to explore some aspects of the solutions Rousseau left sketched elsewhere, especially in Emile and in the Extract and Judgment of the the Abbé de Saint-Pierre's project of perpetual peace, which point to Rousseau's very lucid understanding of the problem of relations between nations, and to a solution that has, surprisingly, much in common with the one that he proposed, in the Social Contract, to the problem of relations between individuals. I Intend to show that there is, in Rousseau, the germ of a conception of international relations that do not reduce them to the mere play of forces proposed by Hobbesian "realism" and, at the same time, allows a regulated and civilized coexistence without imposing the uniformity of values and perspectives characteristic of Kantian cosmopolitanism.Ao ler o Contrato social de Rousseau, tendemos a nos concentrar em seu objetivo explícito, que é o de investigar e estabelecer uma regra de administração legítima e segura para uma comunidade política individual. Em conformidade com o próprio caráter abstrato da obra, somos levados a ver essa comunidade como alguma coisa pré-existente e isolada, sem perguntar o que já havia inicialmente de comum a esses indivíduos que decidem submeter-se à regra de sua vontade geral, e como esse corpo político assim constituído se relaciona com os que não são eles mesmos, mas "os outros", isto é, com as demais sociedades com as quais terá inevitavelmente de conviver. Tais questões tinham grande importância para Rousseau, e só o caráter fragmentário e inconcluso do Contrato social explica por que não receberam o tratamento aprofundado que lhes seria devido. Pretendo, em minha exposição, explorar alguns aspectos das soluções que Rousseau deixou esboçadas em outras obras, especialmente no Emílio e em seu Extrato e Julgamento, do projeto de paz perpétua do Abbé de Saint-Pierre, e que apontam para uma compreensão muito lúcida do problema das relações entre as nações, e para uma solução que tem, surpreendentemente, muito em comum com a que propôs, no Contrato social, para a questão das relações entre indivíduos. Pretendo mostrar que há, em Rousseau, o gérmen de uma concepção das relações internacionais que não as reduz ao mero jogo de forças proposto pelo "realismo" hobbesiano e, ao mesmo tempo, viabiliza a convivência civilizada e regulada, sem impor a uniformidade de valores e perspectivas característica do cosmopolitismo kantiano. What is now generally known as the paradox of art and negative affect was identified as a paradox by the Abbé Jean-Baptiste Du Bos in 1719. In his attempt to explain how people can admire and enjoy representational works that ‘afflict’ them, Du Bos claims that such representations give rise to ‘artificial’ emotions, provide a pleasurable relief from boredom, and offer us epistemic, artistic, and moral rewards. La Théorie des sentiments moraux d’Adam Smith, publiée pour la première fois en anglais en 1759, a été traduite en français quatre fois dans la seconde moitié du xviiie siècle. Puis, après deux siècles de simples rééditions, durant le xixe siècle et jusqu’à la toute fin du xxe siècle, une nouvelle traduction française a paru en 1999. Le présent article commence par des considérations méthodologiques portant sur le statut de la traduction comme retraduction, montrant en quoi l’acte de retraduire peut (...) être l’occasion d’un sentiment paradoxal d’insoutenable légèreté. On en déduit la nécessité d’étudier toute traduction par rapport à ce que l’on peut nommer son contexte objectif et son projet subjectif. C’est seulement à partir de la compréhension de ce contexte et de ce projet de traduction – lesquels peuvent être de nature politique, intellectuelle, économique, etc. – que l’on peut rendre compte des différents choix techniques de traduction qu’ont opérés les traducteurs successifs. Ainsi, on explique en quoi la traduction réalisée par la marquise de Condorcet en 1798 s’inscrit dans le contexte de la Révolution française du point de vue politique, et dans celui du rationalisme moral du point de vue philosophique. Par contraste, la traduction de Michaël Biziou, Claude Gautier et Jean-François Pradeau en 1999 correspond d’un point de vue politique à des interrogations portant sur le libéralisme économique, et d’un point de vue philosophique à la volonté d’interpréter Smith comme représentant du sentimentalisme moral. Many scholars claim that Abbé Sieyès (1748–1836) was the first to deploy the concept of a pouvoir constituant (constituent power) as the power that establishes a constitutional order under which the ordinary powers of government are conferred. Others find the substance of the theory to have been articulated by earlier figures such as Jean-Jacques Rousseau, whilst conceding that the terminology of pouvoir constituant was not used until Sieyès. What no one has observed until now is that the Scottish (...) Presbyterian divine, Samuel Rutherford (1600–1661), can lay claim to being the first to explicitly use the language of constituent power and to develop a theory of the grounds of constitutional government expressly in those terms. Rutherford argues that “the constituent is above that which is constituted,” and thus draws a clear distinction between constituent and constituted power. Furthermore, he vests the former ultimately in the people while the King possesses only constituted power. Rutherford presented a theory of constituent power that had all the essential elements of the theory of pouvour constituant we find in Sieyès, albeit a theory embedded in a political and intellectual context as different from that of Sieyès as his is from our own. The objective of this study is to analyze the measurability and interfirm comparability of sustainability performance through the qualitative content analysis of 12 sustainability reports of mining firms using the Global Reporting Initiative guidelines. The systematic comparison of information disclosed in 92 GRI indicators sheds light on the reasons underlying the impossibility of rigorously measuring and comparing the sustainability performance of firms from the same sector, which are supposed to be strictly following the same reporting guideline. These reasons include qualitative (...) aspects of sustainability, lack of compliance with GRI protocols, indicator contingency, ambiguous or incomplete information, data heterogeneity, and report opacity. The study makes it possible to return to the very notion of sustainability, its meaning, and flexible application by organizations. The results are discussed from three different theoretical perspectives, each of which proposes possible and complementary explanations of the main findings. (shrink)

In this article I attempt to survey work on Hobbes within the period from 1975 to 1989. The text is restricted almost exclusively to work in English on topics in moral and political philosophy. The bibliography is more comprehensive, including work on other aspects of Hobbes’ philosophy and work written in a variety of other languages.The central questions on which the text focuses are these: what psychological assumptions underlie Hobbes’ moral and political conclusions? in particular, what roles do egoism, the (...) striving for self-preservation, and the desire for glory play in his system? to what extent is Hobbes committcd to the claim that the state of nature is a war or all against all? does that war stem from human rationality or from human irrationality? does Hobbes view morality as entirely a human invention, a creation of the state? if people had the psychology Hobbes assumes in justifying the institution of a sovereign, would they be able to institute one? to what extent does Hobbes regard rebellion as justifiable?I devote an attention some people may find excessive to recent works by Greg Kavka and Jean Hampton. I share Gautier’s view that they will prove landmarks in Hobbes scholarship. But I do try also to pay attention to other interesting work by authors like Richard Tuck, Tom Sorell, and David Johnston, and I have many criticisms to make of Kavka and Hampton. (shrink)

Research on reasoning about consequential arguments has been an active but piecemeal enterprise. Previous research considered in depth some subclasses ofconsequential arguments, but further understanding of consequential arguments requires that we address their greater variety, avoiding the risk of over-generalisation from specific examples. Ideally we ought to be able to systematically generate the set of consequential arguments, and then engage in random sampling of stimuli within that set. The current article aims at making steps in that direction, using the theory (...) of utility conditionals as a way to generate a large set of consequential arguments, and offering one study illustrating how the theory can be used for the random sampling of stimuli. Itis expected that further use of this method will bring more diversity to experimental research on consequential arguments, and more robustness to models of argumentation from consequences. Four experiments examined the strategies that individuals develop in sentential reasoning. They led to the discovery of five different strategies. According to the theory proposed in the paper, each of the strategies depends on component tactics, which all normal adults possess, and which are based on mental models. Reasoners vary their use of tactics in ways that have no deterministic account. This variation leads different individuals to assemble different strategies, which include the construction of incremental diagrams corresponding to mental models, (...) and the pursuit of the consequences of a single model step by step. Moreover, the difficulty of a problem (i.e., the number of mental models required by the premises) predisposes reasoners towards certain strategies. Likewise, the sentential connectives in the premises also bias reasoners towards certain strategies, e.g., conditional premises tend to elicit reasoning step by step whereas disjunctive premises tend to elicit incremental diagrams. When is a conclusion worth deriving? We claim that a conclusion is worth deriving to the extent that it is relevant in the sense of relevance theory (Sperber & Wilson, 1995). To support this hypothesis, we experiment with ''indeterminate relational problems'' where we ask participants what, if anything, follows from premises such as A is taller than B, A is taller than C . With such problems, the indeterminate response that nothing follows is common, and we explain why. We distinguish (...) several types of determinate conclusions and show that their rate is a function of their relevance. We argue that by appropriately changing the formulation of the premises, the relevance of determinate conclusions can be increased, and the rate of indeterminate responses thereby reduced. We contrast these relevance-based predictions with predictions based on linguistic congruence. (shrink)

Using methods of abstract logic and the theory of valuation, we prove that there is no paraconsistent negation obeying the law of double negation and such that $\neg(a\wedge\neg a)$ is a theorem which can be algebraized by a technique similar to the Tarski-Lindenbaum technique.
